These Terms of Service (“Terms”) govern your use of the website www.yuvart.pictures

and services provided by Viktar Yushkevich Yuvart,

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Use of the Site

1.1. The Site is intended for viewing and purchasing artworks and for obtaining information about the Company’s products and services.
1.2. You agree to use the Site lawfully and not infringe the rights of other users or third parties.
1.3. You agree not to undertake actions that may disrupt the Site, servers, or network infrastructure.

2. Registration and Accounts

2.1. Creating an account may be required for purchases or access to certain features.
2.2. You must provide accurate registration information and keep it up to date.
2.3. You are responsible for keeping your login and password secure and for all activity under your account.
2.4. Guests may make purchases without creating an account.

3. Purchases and Payments

3.1. Prices
Prices are displayed in EUR (€). Equivalent approximate prices may also be shown in:

US Dollar ($)
British Pound (£)
Polish Złoty (zł)

Exchange rates are indicative only; the final payment amount is processed in the currency selected at checkout (usually EUR).

3.2. Payments are processed via third-party providers (PayPal, Stripe,). The Company does not store full credit card data.
3.3. By placing an order, you confirm that you are of legal age to make purchases.

4. Custom & Ready-Made Artworks

4.1. All artworks are either ready-made or created upon customer request (custom-made).
4.2. Custom artworks are made specifically for the customer. Changes or cancellations after work has begun may not be accepted.
4.3. Estimated completion time for custom artworks is approximately 30 days, depending on size and complexity.
4.4. All artworks are professionally packaged and photographed before shipping with the carrier label to document proper packaging and correct item delivery.

5. Shipping and Risk

5.1. Shipping is performed by partner courier services (DHL, InPost).
5.2. Risk of loss or damage during shipping passes to the buyer once the shipment is handed over to the carrier.
5.3. The Company is not responsible for delays, loss, or damage caused by external carriers.
5.4. Shipping costs are non-refundable, except when the seller is at fault (e.g., incorrect item sent).

6. Damaged or Incorrect Items

6.1. If an artwork arrives damaged despite proper packaging or an incorrect item is delivered due to seller error, the customer must contact the seller within 48 hours and provide clear photos.
6.2. After verification, the seller may offer either:

replacement artwork, or
refund of the purchase price

7. Intellectual Property

7.1. All content on the Site, including images, texts, graphics, and designs, is owned or licensed by the Company.
7.2. No content may be copied, reproduced, distributed, or used commercially without written permission.

8. Limitation of Liability

8.1. The Site is provided “as is.” The Company does not guarantee accuracy, completeness, or uninterrupted operation.
8.2. The Company is not liable for any damages arising from the use of the Site, including direct, indirect, incidental, or punitive damages.
8.3. The Site may contain links to third-party websites. The Company is not responsible for their content or privacy practices.

9. Privacy

Use of personal data is governed by the Company’s Privacy Policy.

10. Changes to Terms

The Company may modify these Terms at any time. Updated versions will be posted on the Site with the update date.

11. Governing Law

11.1. These Terms are governed by the laws of Poland and applicable EU legislation.
11.2. For users in other countries, local consumer protection laws may also apply.
